{"id":1585,"date":"2007-11-20T19:28:26","date_gmt":"2007-11-21T07:28:26","guid":{"rendered":"http:\/\/www.horace.org\/blog\/2007\/11\/20\/legal-languages\/"},"modified":"2007-11-20T19:28:26","modified_gmt":"2007-11-21T07:28:26","slug":"legal-languages","status":"publish","type":"post","link":"https:\/\/www.horace.org\/blog\/2007\/11\/20\/legal-languages\/","title":{"rendered":"Legal Languages"},"content":{"rendered":"<p><a href=\"https:\/\/i0.wp.com\/www.horace.org\/blog\/wp-content\/uploads\/2007\/11\/img_0859.jpg\" title=\"APEGBC Bylaw 1\"><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/www.horace.org\/blog\/wp-content\/uploads\/2007\/11\/img_0859.jpg?w=474\" alt=\"APEGBC Bylaw 1\" \/><\/a><a href=\"https:\/\/i0.wp.com\/www.horace.org\/blog\/wp-content\/uploads\/2007\/11\/img_0860.jpg\" title=\"APEGBC Bylaw 2\"><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/www.horace.org\/blog\/wp-content\/uploads\/2007\/11\/img_0860.jpg?w=474\" alt=\"APEGBC Bylaw 2\" \/><\/a><\/p>\n<p>Legal languages often doesn&#8217;t make any sense, here is a good example.<\/p>\n<p>The APEGBC, the self governing body of BC professional engineers, is asking its members to ratify a bylaw amendment.\u00a0 Recently, the court declared the section regarding the experience requirements of registering as a professional engineers is invalid, since someone who failed to register as a P.Eng take it to court to challenge the 51 years old bylaw.\u00a0 The court require the associate to fix the bylaw, provide sufficient detail on experience requirement in order to registering new members.<\/p>\n<p>The original bylaw has just a short paragraph.\u00a0 In my opinion, it clearly states the experience requirement in plain English.\u00a0 It has been using for 51 years and no one is confused about the experience requirements to register as P.Eng.\u00a0\u00a0 Somehow the judge think the bylaw is not detail enough, so the association hire some lawyers to encrypt the paragraph into 2 pages of legal language.\u00a0\u00a0 I tried to read the new bylaw.\u00a0 I think is actually more confusing than the old one.\u00a0 No lay person really know the true meaning of those legal terms.<\/p>\n<p>The whole exercise of rewriting the bylaw does not change how the association registers new engineers.\u00a0 The registration and review process is business as usual and the experiment requirements stays the same.\u00a0 Everything is exactly the same as before except the bylaw is 2 pages longer and less readable.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Legal languages often doesn&#8217;t make any sense, here is a good example.
